This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “You”) and Parracity Web Pty Ltd (“Parracity Web”) for the use of the Oydee App (“the App”). By installing, accessing, or using the App, you agree to be bound by the terms and conditions of this Agreement.
1. License Grant
Parracity Web hereby grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to the terms and conditions of this Agreement.
2. Restrictions
You agree not to:
- Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the App.
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
- Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the App to any third party.
3. Intellectual Property
All content and materials available on the App, including but not limited to text, graphics, logos, images, audio clips, and software, are the intellectual property of Parracity Web or its licensors and are protected by copyright, trademark, and other intellectual property laws.
4. Privacy
Your use of the App is also subject to our Privacy Policy, which outlines how we collect, use, and disclose your personal information. By using the App, you consent to the collection and use of your personal information as described in the Privacy Policy.
5. Termination
This Agreement is effective until terminated by either party. Parracity Web may terminate this Agreement at any time without notice if you fail to comply with any term or condition of this Agreement. Upon termination, you must cease all use of the App and destroy all copies of the App in your possession.
6. Disclaimer of Warranty
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. PARRACITY WEB DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.
7. Limitation of Liability
IN NO EVENT SHALL PARRACITY WEB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE APP, EVEN IF PARRACITY WEB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.
9. Entire Agreement
This Agreement constitutes the entire agreement between you and Parracity Web regarding the use of the App and supersedes all prior or contemporaneous agreements and understandings, whether written or oral, relating to the subject matter herein.
